Ford Fusion named Green Car of the Year

14 hrs.

Despite the popular media?s fixation on battery power, automotive insiders are quick to caution that there is no ?silver bullet? solution, no single technology that will likely meet all the needs for tomorrow?s clean and efficient automobiles.

That message was hammered home by the choice of the 2013 Ford Fusion as the Green?Car of the Year, an award designed to focus the spotlight on the latest clean-tech automobiles.

A key to the decision was the fact that the new midsize sedan offers a broad range of powertrain alternatives, from conventional gasoline power up to an all-new plug-in hybrid.

?That?s an example of automotive democracy,? said Ron Cogan, publisher of Green Car Journal, the organizer of the annual award.

Now in its eighth year, the Green Car of the Year Award has taken a decidedly independent ? some would say counter-intuitive ? approach to picking its winners. While several hybrids have claimed the coveted trophy, jurors have also honored diesels, such as the Audi A3 TDI. And this year?s five finalists included two gas-only models: the Eco version of the 2013 Dodge Dart, and the new Mazda CX-5 SkyActiv crossover.

What?s critical, explained Cogan, is recognizing that, while battery cars and plug-ins may deliver some extremely impressive mileage, most have limited sales potential ?and don?t achieve much of an impact on the environment.? ?Technologies such as Ford?s turbocharged EcoBoost engines may not have quite the mpg numbers, but they can ?set a broader example.?

In the case of the 2013 Ford Fusion, the maker has given buyers a broad palette to choose from, said Ford's?marketing manager Dave Mondragon after accepting the Green Car award.

Mondragon said he was clearly pleased with the honor and hopes it will provide Ford with a way to show how much it has changed its approach to fuel economy. ?We?ve moved from being the laggard to the leader,? he said, noting that the Detroit maker has higher mileage ratings on its products in every segment where it directly competes with Toyota.

The Japanese maker ? which had hoped to snag the Green Car award with its own finalist, the new Prius C ? not only has the best-selling hybrid on the market, the original Prius hatchback, but also has been able to burnish a reputation as the market?s green leader.

Ford hopes that the Green Car award will help it challenge Toyota?s perceptive lead, senior marketing executive Amy Marentec told TheDetroitBureau.com. This ?absolutely? helps, she said, hinting that Ford will soon be promoting the honor in its advertising efforts for the Fusion ? and possibly other products.

?We?re going to have to talk this up.?

The Green Car of the Year award was by no means the only indication at the LA Auto Show that the industry is searching for a broad portfolio of environmentally friendly solutions.

There were a number of pure battery-electric and plug-in models ? such as the Chevrolet Spark EV and Honda Civic PHEV ? unveiled at the annual show. But Audi announced four new diesel models, including a TDI version of the flagship A8. Mazda also lifted the cover on its new Mazda6, a midsize sedan that will share the CX-5?s SkyActiv gasoline engine but also get the new SkyActiv-D diesel during the second half of next year.

Google Play Gets Real: Reviews Will Now Be Posted With Your ...

When you visit a review on Google Play for an app, book, song or movie, you won?t have to worry as much about whether someone is sheepishly hiding behind a computer firing off nasty words, as Google has now flipped on the switch to display your Google+ name and profile picture with all reviews you add to the store.

I?m not so sure this is the best thing in the world, 100%, as you don?t have an option to turn it off. I like the idea of inviting people to share their thoughts, and mixing in real names and pictures if chosen by the user. That way, people know what reviews they might want to trust over other ones that are anonymous and thus, perhaps shady. The company seems to be choosing quality over quantity, though.

Either way, Google is going all the way with its Plus initiative, as I?ve talked about before. Similarly, YouTube began this transition recently. This new initiative on Play is for both web and mobile reviews.

Signed out? No bueno:

Notice that it says ?Reviews are powered by Google+?, which shows how far Google has taken its social approach to all of its products. This isn?t a short-term project, this is a long-term evolution for the company. Those who are praying for it to ?fail? are ill-informed pundits, because this isn?t a Facebook competitor, it?s a shift in how Google?s products weave together. It just works. Speaking of Facebook, its own App Center relies on real identities as well, so lets call this a trend.

Apple?s App Store has a username system, which makes posting gnarly reviews almost a sport. I could see this as a way for Google to invite developers to interact with their users a bit more, rather than pay no mind to the reviews at all?as most developers do on Apple?s version. Apple?s attempts to go social failed. Ping, anyone? Google+ could liven up Google Play. Maybe. Remember, if you use Google products, you have a profile already.

Is anonymity dead on the web? Some would applaud if that were the case. I find that people who are allowed to hide behind false names and avatars are the ones that tend to be the biggest jerks for the most part. That?s not to say that everyone who enjoys anonymity is a jerk, but you get my drift. If you don?t, then read it again.

Jerks love anonymity. Nonjerks don?t mind being themselves. Google has picked a side. Too binary? We shall see. Long live accountability on the web.

Alarming 15-fold increase in inflatable bouncer-related injuries among children

ScienceDaily (Nov. 26, 2012) ? A new study by researchers at the Center for Injury Research and Policy of The Research Institute at Nationwide Children's Hospital examined pediatric injuries associated with inflatable bouncers, such as bounce houses and moonwalks. Researchers found that from 1995 to 2010 there was a 15-fold increase in the number of inflatable bouncer-related injuries that were treated in U.S. emergency departments among children younger than 18 years of age. In 2010 alone, more than 30 children per day, or about one child every 45 minutes, were treated in hospital emergency departments for injuries associated with inflatable bouncers.

The study, available online November 26, 2012 and published in the December 2012 print issue of Pediatrics, found that while fractures (28 percent) and strains or sprains (27 percent) were the most common types of injuries, approximately 1 in 5 injuries (19 percent) were to the head and neck, demonstrating that use of these products can pose serious risks. Falls (43 percent) were the most common cause of injury followed by stunts and collisions. The majority of the injuries occurred either in a recreational setting (44 percent) or at home (38 percent).

"The findings from this study show that there has been an alarming increase in the number of injuries from inflatable bouncers," said Gary A. Smith, MD, DrPH director of the Center for Injury Research and Policy at Nationwide Children's Hospital. "It is time for us to take action to prevent these injuries. Ensuring that parents are aware of the potential risks, improving surveillance of the injuries, developing national safety guidelines and improving bouncer design are the first steps."

The study authors point out that the injury patterns for inflatable bouncers and trampolines are very similar, and although there are national safety guidelines for trampoline use, no such guidelines exist for inflatable bouncers.

"The medical and public health community has yet to provide recommendations on the safe use of inflatable bouncers," said Dr. Smith, also a professor of Pediatrics at The Ohio State University College of Medicine. "The growing epidemic of inflatable bouncer injuries make it clear that it is time to do so."

Until national safety guidelines are in place, parents should consider the risks before allowing their child to use an inflatable bouncer. If parents allow their child to use an inflatable bouncer, they should consider limiting use to children 6 years of age and older, requiring that an adult be present to supervise while the bouncer is in use and allowing only one child on the bouncer at a time. If more than one child will be on the bouncer at the same time, the children should be approximately of the same age and size.

This is the first study to use a nationally representative sample to examine injuries associated with inflatable bouncer-related injuries that were treated in U.S. emergency departments. Data for this study were obtained from the National Electronic Injury Surveillance System (NEISS), which is operated by the U.S. Consumer Product Safety Commission. The NEISS provides information on consumer product-related and sports and recreation-related injuries treated in hospital emergency departments across the country.

Video: Todd: House Republicans key to fiscal deal

>>> back at work with one big issue staring them in the face. how to avoid going over the so-called fiscal cliff? if they do not reach a deal your taxes could rise and sharp spending cuts would go into effect as well possibly triggering a recession. chuck todd is nbc's political director and chief white house correspondent. chuck, good morning to you.

>> good morning, savannah.

>> the goal here is to get a deal that reduces the deficit, and the battle lines have been pretty clear right now. the president campaigned rolling back the tax breaks for the highest earnings and republicans argued spending cuts are the way to get the deficit under control. are we starting to see a softening of those positions on both sides?

>> reporter: here's what there's agreement on. both sides, both parties agree that the wealthiest have to pay more, and the question now and the sticking point at this stage is how do you go about making the wealthiest pay more? do you do it by raising the tax rates ? that's what president obama wants to do. wants to raise the tax freights 35% where they are now up to where they were during the clinton years at 39% what. republicans are arguing is you don't have to do that. you can get all of the money or some of the money that you want by getting rid of loopholes so doing full-fledged tacts reform at next year but don't raise the tax rates at all and somehow get rid of the loopholes. the white house says, hey, that math doesn't work.

>> let me pick up on that because we've seen a few republicans peeling off from a pledge they signed to grover norquist who, of course, is an anti-tax lobbyist works has been very powerful among conservatives. is that a significant move when you start seeing senators like lindsey grak, sacxby chambliss saying i'm not going to stick to the deal.

>> reporter: i'll be waiting to see if house republicans do it. all the areas where republicans are softening. it's senate republicans . if the deal could be cut between senate republicans and the white house , we wouldn't be talking about this, wouldn't have a segment because the fiscal cliff wouldn't be an issue. the house republicans have to worry about primaries and that's the problem for the white house and frankly for house speaker john boehner . he may want to cut a deal but may not have the votes because these guys might be on a primary suicide mission , some of these house republicans , if they side with raising tax rates . if they raise taxes they will lose the primary and there's no general election , they don't have to where he about voters.

>> are democrats signaling where they may be willing to compromise?

>> reporter: president has been willing to talk about social security and medicare and put entitlements on the table. the problem the president has is many parts of his base, including some of those house democrats that he might need in some sort of forged compromise, they are not crazy about doing that. we won. the mandate is to raise taxes. there was no mandate from the voters to tinker with social security and tinker with medicare, but at some point the president's going to put that on the table, and the question will his base let him do it?

>> let me switch gears a bit. i want to ask you about senator john mccain . he, of course, has been very critical about the potential nomination of u.n. ambassador susan rice to be secretary of state, something that hasn't happened yet. he appeared to strike a more conciliatory tone over the weekend. i'm going to play two statements for you, john mccain a few weeks ago and john mccain yesterday and ask you about it on the other side.

>> we will do whatever is necessary to block the nomination that's within our power as far as susan rice is concerned.

>> i think she deserved the ability and the opportunity to explain herself and her position, just as she said.

>> chuck, very quickly, is this a very significant change?

>> reporter: it is and it tells you something that a lot of people have told me presidents get their secretary of states. the question is how much pain is it going to come with? i'm told it's probably not this week, probably early next week that the president finally decides to name a secretary of state, just down to two, susan rice or john kerry , but hearing that might make the white house feel better. i think the president's gut has been if he were to choose, force him to choose, i think he's leaning susan rice .

>> chuck todd with all the headlines from washington in morning.

Thankful Customer Has Scalp Acne No More! - Lying DC\'s Health ...

Not only is scalp acne uncomfortable, it can be downright embarrassing. I have suffered from it for years, and no matter how clean my hair is, sometimes the flare ups have been so bad, I?m afraid to brush my hair. But I recently saw a press release through PR Log.com, talking about this new shampoo from World of Hair. It?s herbal and natural, zinc-based, and specially designed to help with scalp acne. Even better, it actually works! I?ve never been happier or more in love with my hair!

How are you tracking the Foreclosures in the Santa Clarita Cities ...

With several ways of doing this ?tracking?, one of the things that I would like you to heed is the following warning, ?If you are searching for foreclosures and bank owned inventory ? make sure you are using a local Real Estate agent?s website and resources??

Searching with Local SCV Foreclosure Services:

Giving up your mobile phone number:

Santa Clarita foreclosuresThis could mean the difference between you keeping a cellular number and email address you love or having to change them for another. ?Why? ?Because when you are searching for things like homes, foreclosures, bank owned and auctions, the real estate?syndication?websites know those are ?big trigger? items and people are searching for them hand over fist with millions of inquires a week.

I hate being scammed?

Because they have been built with the ?monetizing of your personal?information? in mind, they work very hard at getting you to give it up. ?While that does not seem like a big deal for some, ask around within your sphere if anyone has ever given away their personal?information?on -line, even innocently, to find out their doing so caused them to be teleported into a SPAM abyss.

How to find a Local Realtor Resource:

It could have been when you were looking for ?cheap homes? or ?best moving companies?. ?Look at the address on the page, is it local? What about the real estate the page is displaying? ?Is if within where you want to buy. ?And I?m not talking about if they have a map of the whole United States ? it should be a bit more localized than that :)

One of the things we love, as Local Santa Clarita real estate agents, is for people to subscribe to become part of our conversation. This is easy and will give you the BEST Santa Clarita housing news has to offer. ?It comes twice a month, no more, no less. ?It?s free and it?s put together by REMAX of Santa Clarita?s Paris911 Team. ?Click here to subscribe to SCV Realtor News and thanks ahead of time for doing so!

What's the difference between Information Technology and Computer

What are the differences in a BS degree in IT and CS? Are the courses a lot different?

To give you the background ? There are a number of viable IT majors ? I?m just covering the big 4 here. Just figure out what you would like to do as these are all good. You need a 4 year degree. If all you have time for is a 2 year degree then that is ok for starters but you will still need to complete years 3&4. Don?t get a certificate type degree or a Devry or ITT Tech degree- not recognized by many employers and credits may not transfer in the future. There are several main Computer majors and their associated career categories and you need to know these just to get the lay of the land. These degree titles are often found in Associates, Bachelors and Masters degree programs. Generally most IT employers are looking for a 4 year Bachelors degree in an IT related major as a minimum requirement. For working people some of these majors are offered by schools in night classes and we are beginning to see online or hybrid online/classroom options available. Depending on the school, a Bachelors degree in an IT field may be a BA or a BS. There does not seem to be any problems for employers with a BA or BS as long as it is a bachelors degree. If you already have a degree in another major, if you have an Associates degree or if you have a bunch or college credits and no degree you can usually find a degree completion program that will allow you to take 14-16 months of classes and graduate with a Bachelors in a computer related major.
Now some of the titles colleges use may consist of different course curriculums. As an example one school may have more programming classes in the same major while another school has fewer. Schools may call their general IT program Computer Information Technology, Computer Information Systems or Computer Information Science. To really tell what the major is about you should look at the courses that a particular school offers in that major. Another point of confusion is job titles you will see. For example, I am called a Computer Systems Engineer but I don?t do anything associated with Computer Engineering. One job I had I was Systems Programmer but I did not do any programming. So the titles for majors and for jobs in IT can be very confusing. Sometimes I will hear someone say they want to pursue Computer Science or Computer Engineering and once they find out what it involves they realize that is not what they want to do. If this is old info, that you already know, apologies. Here are the majors and some associated jobs:

Computer Science (CS) ? A technical degree which usually has a Programming emphasis ? people with this major usually are developing application software, web development, embedded code and robotics. Sometimes depending on the college the degree may cover some more general topics as listed under CIS below. CS is a difficult major and may include a number of advanced math courses. Many CS students find themselves not enjoying programming, not being gifted at it or not having the math and logic skills to be good at programming and they will switch out into CIS. CS majors that are able to graduate can also qualify for jobs listed below under CIS.

Computer Information Systems (CIS) ? This may also be called a variety of other names like Information Technology (IT), Information Systems (IS), etc. This is a general technical degree and is the degree that I have. Holders of these degree work in a variety of technical jobs like these:
Computer Technician, Service Center Coordinator, Help Desk Staff, Storage Administrator, Network Administrator, Systems Administrator, Systems Engineer, Enterprise Administrator, Active Directory Administrator, Exchange and Messaging Administrator, Backup Administrator, Disaster Recovery Specialist, Database Administrator, Computing Security Specialist, Corporate IT Acquisition Specialist and Data Center Administrator, just to name a few.

Computer Engineering ? This is a technical engineering and design degree. These degree holders get jobs related to designing and manufacturing computer related hardware. Obviously when you think of hardware you think of laptops and PCs but this might be all kinds of computer devices like tablets, processors, memory, storage, networking equipment and components of computers.

Management Information Systems (MIS) ? This is a business degree that prepares non-technically trained people to manage projects, budgets and people. Traditionally, senior IT technical pros would eventually be promoted into management positions after years of technical work. The good news is they understood technical challenges their people were working with but the bad news was that some were great tech people but poor people managers. I have had both types of these managers and the new trend is definitely towards these non-technical managers.
Hope this helps.
Best Wishes!

Finding Your Way to a New Venue. | Weisberg Law P.C.

Lay et al. v. Bumpass, CA: 3:11-CV-1543 (M.D.P.A. 2012) is a case which examines the correct place to file a complaint for legal malpractice. This particular decision was based in part on the filing of the complaint in the Middle district of Pennsylvania based on diversity, meaning the plaintiffs were citizens making an allegation against a Defendant from a different state. The facts of the case are below.

Originally, Plaintiffs werePennsylvaniaresidents who alleged an injury based on the negligence of TSA. As a result, their claim was required to be filed under the Federal Tort claims act. The injury form negligence occurred inArkansas, and the Plaintiffs hired anArkansaslawyer to handle the case.

The Plaintiffs alleged that theArkansasattorney, representingPennsylvaniacitizens committed malpractice by failing to follow the standards of the act. Namely, the attorney failed to timely provide notice as required by the FTCA. Thus when Plaintiffs made their claim it was rejected by the TSA due to a violation of the statute of limitations. Plaintiff initiated this malpractice suit after the personal injury suit was rejected for being untimely. The defendant moved to dismiss the case for improper venue in the Middle district of Pennsylvania. The Plaintiff?s main argument that the suit should have been in the Middle district were that 1) the dismissal of their personal injury suit occurred in the Middle district, thus it is the place of injury and 2) all of their experts and evidence were located in the Middle district of Pennsylvania. The court dismissed both arguments. The main problem according to the court is that the FTCA sets out what should be used as venue in a personal injury case. Plaintiffs were alleging malpractice based on the personal injury case representation which is why the court went to the statute. According to the FTCA venue is proper where in the judicial district where the plaintiff resides or wherein the act or omission complained of occurred.

However, that governs the personal injury suit, not the legal malpractice. Thus the court had to go to tort law as opposed to federal law. The venue in discussion in this case was that of the legal malpractice case. There was not a challenge to the venue of the FTCA claim, since by statute that could have been prosecuted inPennsylvania. The Middle district adopted the same rule other courts used that venue is proper in the county where the negligence arose.

In this case, the Plaintiffs got in the door to Federal court based on diversity. Where jurisdiction of the Federal court is based on diversity, the court recognized that by statute the case may be brought in any district where the defendant resides; any district where a substantial part of the case took place; or any district in which any Defendant is subject to personal jurisdiction.

It was uncontested that Defendant did not reside inPennsylvaniathus, that rule was crossed out by the Court. Ditto for personal jurisdiction. Personal jurisdiction did not apply because the attorney fromArkansasdid not do any advertising inPennsylvania. Thus that left only the district where a substantial part of the events occurred.

The Court was then tasked with deciding what district that was for purposes of this case. To establish where the Plaintiffs were when the action occurs in a legal malpractice case involves analyzing the relationship between attorney and client. Based on precedent the court established that a telephone call to a client or a mailing does not establish venue. Neither does the fact that tortuous conduct occurs in one venue when the harm is felt in another. Thus both of those took out specific parts of Defendant?s conduct which caused harm to Plaintiffs. The court could not find acts of the Defendant which also gave rise to venue.

At this point, Plaintiffs were out of ammunition, because a finding of personal jurisdiction would have been a due process clause question which is an article for another day. Plaintiffs hired anArkansasbased attorney to prosecute their claim, thus the court found there was no intentional relationship withPennsylvania. Additionally, all aspects of representation occurred inArkansas, thus the court transferred the case accordingly.

The reason Plaintiffs seek to file in certain courts is based on remedies. While this case may seem to have been an open and shut instance of filing in the wrong venue, Plaintiffs attorney was attempting to utilize the strategic advantage Plaintiffs gain in his view. While it was unsuccessful, it is important to keep in mind the three ways a diversity suit may come under the auspices of a court which would seem not to have an interest. This is increasingly important given the inter-connectivity in the computer age.

Jobless claims slip; Sandy?distorts data

15 hrs.

Fewer Americans filed for unemployment benefits in the latest week, according to government data Wednesday?that still suffered the after-effects of Superstorm Sandy on the Northeast.

The Labor Department reported that new?jobless claims fell a seasonally-adjusted 41,000 to 410,000. The four-week moving average, which smooths out some of the wrinkles in the data, rose 9,500 to 396,250. The data was released a day earlier than usual because government offices will be closed Thursday for the Thanksgiving holiday.

The storm, which slammed the East Coast, killed over 100 in the U.S. and destroyed thousands of homes and businesses, and left millions without electricity, has elevated the claims data. It's likely to continue to do so for another week, at least.?The storm caused nearly 44,000 people in New York and 31,000 in New Jersey to seek unemployment aid two weeks ago, the latest state data available.?

Before the storm, applications fluctuated between 360,000 and 390,000 for most of this year. At the same time, the unemployment rate fell from 8.3 percent to 7.9 percent.?

The storm has distorted a range of economic indicators, making it harder to gauge the underlying health of the U.S. economy. Economists thought Wednesday's readings nevertheless point to a struggling jobs market.?

"There appears to be a noticeable deceleration of growth in the fourth quarter," said Peter Hooper, an economist at Deutsche Bank in New York. "It would not be surprising if some of the new jobless claims are due to underlying weakness in the labor market," he said.?

The data covers the same week when the department collects data for its estimate on hiring during the month, and gives some reason to expect softness in that report due on December 7, although not all analysts expect a significant impact. Nonfarm payrolls grew 171,000 in October.

"We are expecting things to be in the neighborhood of what we have seen, maybe with a pullback in light of the hurricane," said Bricklin Dwyer, an economist at BNP Paribas in New York.

The drop in new claims only partially unwinds the 90,000-claim increase registered the prior week. The Labor Department revised upward its estimate for new claims in the week ending Nov 10 to 451,000. Millan Mulraine, an economist with TD Securities in New York, said the storm would continue to distort claims for another few weeks.

However, most analysts think the economic impact of the storm is likely to be temporary.

Growth in the U.S. economy has looked uneven in recent months, with business investment sagging due to fears that Congress will slash the budget deficit next year, while consumer spending and the housing market have looked more robust.?

?The Associated Press and?Reuters?contributed to this report.

Rutgers joins the Big Ten, leaving Big East behind

PISCATAWAY, N.J. (AP) ? Rutgers is joining the Big Ten, leaving the Big East behind and cashing in on the school's investment in a football program that only 10 years ago seemed incapable of competing at the highest level.

The school announced its decision Tuesday at a campus news conference attended by Big Ten Commissioner Jim Delany, Rutgers President Robert Barchi and athletic director Tim Perenetti.

"The Big Ten is really where Rutgers belongs," Barchi said.

Rutgers has been competing in the Big East since 1991. But the league has been picked apart by conference realignment, and the Scarlet Knights were looking for a way out.

They landed in the best possible spot. A spot that seemed unthinkable a decade ago when Rutgers football was a Big East cellar-dweller.

"It's a transformative day for Rutgers University," Pernetti said.

The move follows Maryland's announcement Monday that it was joining the Big Ten in 2014.

Rutgers also plans to join its new conference in 2014, though the Big East requires 27 months' notification for departing members. The Scarlet Knights will have to negotiate a deal with the Big East to leave early.

Whenever Rutgers enters the Big Ten, it will be the culmination of one of the most remarkable turnarounds in college sports.

In 2002, the Scarlet Knights football team went 1-11 under second-year coach Greg Schiano, who then seemed like the latest coach incapable of reviving a program that had been a college football laughingstock for more than a decade.

The team, however, made steady improvement as the university made the huge financial commitment necessary to support major college football.

Facilities were upgraded, the on-campus stadium was expanded and as Schiano started to win, his salary began to rise into the millions. Not everyone on campus embraced the idea of turning Rutgers into a big-time football school, and it did come with a big price tag.

The expanded and renovated stadium cost of $102 million. The school had hoped to raise the money through private donors, but fell short. Rutgers scaled back plans for the expansion and issued bonds and borrowed money to complete the project.

In 2006, the school had to cut six varsity sports, including men's tennis and crew. As the football team has become a consistent winner ? Rutgers has gone to a bowl six of the last seven years ? the athletic department has received tens of millions in subsidies from the university.

Schiano left for the NFL last year, and Rutgers hired longtime assistant Kyle Flood, who has the Scarlet Knights poised to take make another big step. No. 21 Rutgers (9-1) is in position to win its first Big East championship and go to a BCS game for the first time.

In the Big Ten, the revenue Rutgers receives from the league's television and media deals should quadruple in the short term and could be even more than that in years to come.

The Big Ten reportedly paid its members about $24 million last year. The Big East's payout to football members last year was $6 million.

In exchange, the Big Ten gets a member in the largest media market in the country, and new presence along the East Coast, with Rutgers and Maryland as north and south bookends.

Second-quarter sales grow 2% for locally tied Medtronic group ...

Tuesday, November 20, 2012, 3:40 pm

By Dan Verel, Business Journal Staff Reporter

MedtronicSANTA ROSA ? Second-quarter sales for Medtronic?s Cardiac and Vascular Group, which includes operations in Santa Rosa, increased 2 percent from a year before,?while most other measures remained the same, according to financial results reported today.

Group sales totaled $2.137 billion for the quarter ended Oct. 26.?Santa Rosa-based Coronary and Renal Denervation and Endovascular Therapies business units, employing 800 locally, are part the?Cardiac and Vascular Group of?Minneapolis-based?Medtronic (NYSE: MDT).

Solid growth in coronary, endovascular, structural heart and AF Solutions helped offset declines in pacing for the Cardiac and Vascular Group, according to the device maker. Group international sales of $1.168 billion increased 7 percent on a constant-currency basis from a year?before?but as reported were unchanged. Total group revenue of $1.227 billion was flat after adjusting for currency and down 3 percent overall.

Second-quarter revenue from implantable cardioverter defibrillators was unchanged at $689 million, while revenue from heart-pace devices was $480 million, a decline of 2 percent when adjusting for currency exchange rates. But that was partially offset by coronary revenues, which grew 19 percent to $429 million, excluding currency adjustments.

Medtronic?s drug-covered Resolute Integrity stent helped spur growth, with sales of stents increasing by 39 percent when adjusted for currency.

Quarterly net earnings for the company as a whole decreased 26 percent, or 63 cents per diluted share, on worldwide revenue of $646 million. Medtronic attributed the decline to a?$245 million?one-time litigation charge in its Structural Heart business.

That charge resulted from a $74 million jury award to Edwards Lifesciences Corp, which claimed patent infringement in Medtronic?s making of its CoreValue transcatheter aortic valve. The ruling was upheld last week by the U.S. Court of Appeals.

Structural-heart device revenue of $271 million grew by 2 percent, while endovsacular device sales increased 12 percent to $210 million.

The price of Medtronic shares increased 2 percent to $42.66 at the close of trading Tuesday. After-hours pricing was lower at $42.50 per share.

'Sons of Anarchy': Making a case for TV violence

NEW YORK (AP) ? I want to pay tribute to TV violence.

In particular, I want to celebrate "Sons of Anarchy," FX network's bloodthirsty and brilliant drama series about a motorcycle gang. (It airs Tuesday at 10 p.m. EST.)

Now I don't make a habit of championing violence, even make-believe violence on my TV screen On the contrary, I count myself among those viewers who stew about the excess of violence on TV. Almost every scripted drama, it seems, habitually embraces violence in its storytelling.

And more to the point, gun violence. With TV drama, guns are standard issue, a staple of the storytelling lexicon. (How many, or rather how few, TV dramas you can name where guns aren't part of the act?)

Debates about TV violence have raged since TV began and usually go nowhere, bogging down in a jumble of the First and Second Amendments. That is, viewers feel constitutionally guaranteed the right to bear arms ? and to be entertained by watching others who bear them. Then, with every new outbreak of real-world gun violence, the debate is reignited and the media scapegoated. Nothing is resolved.

This is not to say that certain violence-prone shows don't manage to fly under the radar. Some do it by shrouding themselves in righteousness. Consider "Law & Order: SVU," a have-it-both-ways series that for 14 seasons has luxuriated in violence as something to be condemned while, at the same time, titillating viewers with the sex crimes it wallows in.

Similarly, the "CSI" franchise savors violence retroactively, back in the lab, with graphic deconstructions of each weekly episode of violence.

But it's not all gratuitous violence on TV. A relative handful of dramas earn immunity, as well as acclaim, by putting violence in the service of higher truths. Think of great shows like "The Sopranos," ''Boardwalk Empire," ''Breaking Bad" or "The Shield."

And add "Sons" to the list of hard-hitting series that justify their violent eruptions with the larger stories they tell.

Simply put, "Sons" is a family/workplace drama. It tells of a motorcycle club ? the Sons of Anarchy, or SAMCRO ? set in the ironically named California town of Charming, where its members do business in drugs, porn and gunrunning while they grapple with rival gangs, shifting alliances and, of course, the law.

In the home stretch of its fifth season, "Sons" by now has spun a sprawling mythology that even included a past story arc set in Northern Ireland. But the saga centers on this family trio: Jax (Charlie Hunnam), his mother, Gemma (Katey Sagal), and her husband, Clay (Ron Perlman), once the club's president.

More recently, Jax has seized the throne from Clay, his stepfather. This has set in motion a Shakespearean-like battle for power that seems sure to end with one of them slaying the other.

Meanwhile, Jax is strategizing how to move the club into more legitimate pursuits. But as he readily admitted on last week's episode, any path of reform "is gonna be bloody, bro."

"Sons" has always been bloody, and then some.

A few seasons ago, a band of white separatists sent SAMCRO a "message" by abducting Gemma, the club's matriarch, and, in a grisly sequence, gang-raping her.

Early this season, the daughter of a SAMCRO member was burned alive while he was forced to watch the horrid killing helplessly.

And just last week, Big Otto, a SAMCRO member who's on death row, viciously stabbed to death a prison nurse with a contraband crucifix. But however shocking, this scene had a sound dramatic purpose. Like other violence on "Sons," it propelled the narrative in yet-to-be-seen ways. An act of complex retribution against Jax, Otto's scheme was as diabolical as it was depraved, and it will fuel future plot twists. Nothing on "Sons" takes place in isolation.

The recurring character Otto is played by Kurt Sutter, whose more prominent roles on "Sons" are as its creator, writer and executive producer (and who, by the way, is married to Katey Sagal).

Sutter says the initial concept for "Sons" was aimed at exploring "what a family dynamic looks like in a subculture that has its own set of rules, its own governing body, its own lifestyle ? yet faces some of the same daily challenges we all do."

Jax seems intent on eventually escaping this criminal life with his longsuffering wife (Maggie Siff) and their two sons.

"I see an end," Jax told her last week.

But Sutter doesn't see an end to "Sons" for at least two more seasons, which surely means more struggle and bloodshed for Jax and company.

That's good news for the series' audience, which has grown steadily season by season, currently averaging 6.6 million viewers weekly.

"There's a pulp quality to my show that allows me to push the boundary and tell some bigger-than-life stories," Sutter says. "But what grounds the story is that we see the ramifications of the bad things the characters do. That creates a sense of karmic responsibility for what we're putting out there. It doesn't feel so much like, 'Oh, there's just violence for violence's sake, or sex for sex's sake.' Viewers understand how it fits into the bigger picture."

Part of the bigger picture is that, however engaging these ruffians may be ? you just can't help rooting for Jax and his confederates, no matter how brutish their behavior ? there's no glamourizing the lives they lead.

"The irony of this outlaw culture is that it's supposed to be all about breaking the rules and being free," says Sutter ? yet the Sons are stricken by their own code of conduct. They remain trapped, on high alert and under constant threat. "It's not a life I would want to live," Sutter says with a laugh.

But it's a life that's fascinating to watch. For violence this raw and bracing, yet full of dramatic consequences, I've got just one thing to say about "Sons of Anarchy" every week: Hit me again!

Top Insider Trades: Liberty Media Turns Up Dial On Sirius XM Radio ...

In a victory for common sense, the trading behavior of company executives, directors, and large shareholders in the stocks of firms they're registered "insiders" at have been proven profitable to monitor by both academic studies and (more importantly) the experience of your fellow professional investors.

Below are lists of the top 10 mainly open-market insider purchases and sales filed at the Securities and Exchange Commission Friday, November 16, 2012 as ranked by dollar value.

Please note, however, that these are factual lists, not buy and sell recommendations. Dollar value is only one metric to assess the importance of an insider transaction, and, frankly, often not even the most important metric that determines if an insider transaction is significant.

Liberty Media (NASDAQ:LMCA), chaired by John C. Malone, has turned up the dial on its Sirius XM Radio (NASDAQ:SIRI) stake, making an open market buy of $82.4 million in the satellite radio company. Now holding 49.8%, LMCA is simply awaiting a go-ahead from the Federal Communications Commission to take over official control of its former affiliate. Malone has been a director of Sirius since April 2009. The investment firm managing the majority of Bill Gates' fortune, Cascade Investments, continues to stock up on Republic Services (NYSE:RSG). With its most recent acquisition of $31.2 million in the non-hazardous waste company, its stake is now over 23%.

WisdomTree Investments' (NASDAQ:WETF) president, CEO, and director, Jonathan L. Steinberg, sold $93 million worth of the asset management company's stock on the open market, according to the SEC. Also cashing out is RRE Venture Capital, an early backer of WETF, which sold $93.1 million worth of the company's stock. Over the past year, no company insiders have purchased stock. WisdomTree focuses on exchange-traded funds.

At InsiderInsights.com, we find new investment ideas just about every day using these and more intricate insider screens to determine where we should focus our subsequent fundamental and technical analysis. And while stocks don't (or shouldn't) move up or down based on insider activity alone, insiders tend to be good indicators of when real stock-moving events like earnings surprises, corporate actions, and new products may be in the offing.

US Cellular promo brings unlimited LTE to smartphone owners for $40 per month, but tethering is another $20

DNP US Cellular now serving all you can eat data for $40 per month

A US Cellular rep confirmed today that the carrier is now offering a new unlimited 4G LTE data plan. Customers within the company's LTE markets can now add unlimited 4G data for $40 per month -- only through January 31st of next year, though. If surfing the web on a smartphone isn't enough, you can add optional tethering for an additional $20, which requires a separate tiered hotspot data plan. Just in time for the holidays, this ample offering lines up with the carrier's recent LTE expansion and its plan to bring 4G access to 58 percent of its customers by the end of the year. In addition to this promotional data plan, US Cellular is offering a $100 instant rebate on select smartphones, including the Huawei Ascend Y and Samsung Galaxy S III. Not stopping there, anyone who purchases a smartphone or tablet can score a free Samsung SCH-LC11 hotspot. It's uncertain if this is truly unlimited data or the type that comes with a throttled cap. So, we'd caution you not to go on a Netflix and Pandora binge, as such activities could result in a nastygram from US Cellular for use beyond what the fine print allows.

Japan, NKorea to talk again, but no breakthroughs

TOKYO ? Japanese officials say Japan and North Korea have agreed to meet again after talks this week produced no breakthroughs on longstanding issues.

Foreign Ministry spokesman Masaru Sato said Saturday that the two countries acknowledged the talks in the Mongolian capital of Ulan Bator were "useful for the improvement of the two countries' relations." He said they agreed to cooperate on issues that have long strained their ties, including the abductions of Japanese citizens by North Korea in the 1970s and '80s, Pyongyang's missile and nuclear programs, and compensation for Japan's wartime past. The two countries have no formal diplomatic relations.

The meeting Thursday and Friday followed lower-level negotiations in August, the countries' first bilateral talks in four years.

Smoke rises following an Israeli attack on Gaza City, Thursday, Nov. 15, 2012. Israel barraged the Gaza Strip with airstrikes and shelling Wednesday and killed the Hamas military chief in a targeted strike, launching a campaign aimed at stopping rocket attacks from Islamic militants. The assault killed 10 other Palestinians, including two children and seven militants. (AP) ? Israel will suspend its offensive in the Gaza Strip on Friday during a brief visit by Egypt's premier there if militants refrain from firing rockets at Israel, an official said, the first possible break in the escalating conflict.

An official in Prime Minister Benjamin Netanyahu's office said the Israeli leader was responding to an Egyptian request.

Israel told the Egyptians the military "would hold its fire on the condition that during that period, there won't be hostile fire from Gaza into Israel," the official said. "Prime Minister Netanyahu is committed to the peace treaty with Egypt, which is in the strategic interest of both countries, he added, speaking on condition of anonymity to discuss the diplomatic exchange.

It wasn't clear whether Israel hoped to use the possible suspension of hostilities to seek a broader truce or was agreeing to the halt in fighting only as a gesture to Egypt.

Three days of fierce fighting between Israel and Gaza militants has widened the instability gripping the region, straining already frayed Israel-Egypt relations. The Cairo government recalled its ambassador in protest and said it was sending its prime minister, Hesham Kandil, to Gaza for a three-hour visit Friday in a show of solidarity with the Palestinian territory's militant Hamas rulers.

Egyptian intelligence officials involved in negotiations to end previous rounds of fighting are accompanying Kandil on his visit, an Egyptian diplomat said, suggesting it is more than a display of support.

The diplomat said Gaza militants have told Egyptian intelligence officials they would be willing to hold their fire if Israel would commit to mediation to stop its military operation and targeted killings.

Word of the possible pause in the fighting came after a night of fierce exchanges and signals that Israel might be preparing to invade Gaza. Overnight, the military said it targeted about 150 of the sites Gaza gunmen use to fire rockets at Israel, as well as ammunition warehouses, bringing to 450 the number of sites struck since the operation began Wednesday.

Israeli troops, tanks and armored personnel carriers massed near the Palestinian territory, signaling a ground invasion might be imminent.

Militants unleashed dozens of rocket barrages overnight.

Fighting between the two sides escalated sharply Thursday with a first-ever rocket attack from Gaza on the Tel Aviv area, menacing Israel's most densely populated area. No casualties were reported there, but three people died in the country's rocket-scarred south when a projectile slammed into an apartment building.

The death toll in Gaza climbed to 19, including five children, according to Palestinian health officials, as waves of Israeli fighter planes and drones sent missiles hurtling down on suspected weapons stores and rocket-launching sites.

Early Friday, 85 missiles exploded within 45 minutes in Gaza City, sending black pillars of smoke towering above the coastal strip's largest city. The military said it was targeting underground rocket-launching sites.

One missile flattened sections of the Interior Ministry, leaving a huge pile of rubble, and another hit an uninhabited house belonging to a senior Hamas commander. Those strikes, together with an attack on a generator building near the home of Gaza's Hamas prime minister, Ismail Haniyeh, signaled that Israel was expanding its offensive beyond military targets.

Israel and Hamas had largely observed an informal truce since Israel's devastating incursion into Gaza four years ago, but rocket fire and Israeli airstrikes on militant operations continued sporadically. The latest flare-up exploded into major violence Wednesday when Israel assassinated Hamas' military chief, following up with a punishing air assault meant to cripple the militants' ability to terrorize Israel with rockets.

The Israeli offensive has not deterred the militants from firing more than 400 rockets aimed at southern Israel, the military said. On Thursday, they also unleashed for the first time the most powerful weapons in their arsenal ? Iranian-made Fajr-5 rockets capable of reaching Tel Aviv.

The two rockets that struck closest to Tel Aviv appear to have landed in the Mediterranean Sea, defense officials said, and another hit an open area on Tel Aviv's southern outskirts.

No injuries were reported, but the rocket fire sowed panic in Tel Aviv and made the prospect of a ground incursion more likely. The government later approved the mobilization of up to 30,000 reservists for a possible invasion.

Netanyahu said the army was hitting Hamas hard with what he called surgical strikes, and warned of a "significant widening" of the Gaza operation. Israel will "continue to take whatever action is necessary to defend our people," said Netanyahu, who is up for re-election in January.

At least 12 trucks were seen transporting tanks and armored personnel carriers toward Gaza late Thursday, and buses carrying soldiers headed toward the border area.

An Israeli ground offensive could be costly to both sides. In the last Gaza war, Israel devastated parts of the territory, setting back Hamas' fighting capabilities but also paying the price of increasing diplomatic isolation because of a civilian death toll numbering in the hundreds.

The current round of fighting is reminiscent of the first days of that three-week offensive against Hamas. Israel also caught Hamas off guard then with a barrage of missile strikes and threatened to follow up with a ground offensive.

Much has changed since then.

Israel has improved its missile defense systems, but it is facing a more heavily armed Hamas. Israel estimates the militants have 12,000 rockets, including more sophisticated weapons from Iran and from Libyan stockpiles plundered after the fall of Moammar Gadhafi's regime there last year.

Also, regional alignments have changed dramatically since the last Gaza war. Hamas has emerged from its political isolation as its parent movement, the region-wide Muslim Brotherhood, has risen to power in several countries in the wake of last year's Arab uprisings, particularly in Egypt.

At the same time, while relations with Israel have cooled since the toppling of longtime Egyptian leader Hosni Mubarak, Islamist President Mohammed Morsi has not brought a radical change in Egypt's policy toward Israel. He has promised to abide by Egypt's 1979 peace deal with Israel and his government has continued contacts with Israel through its non-Brotherhood members.
